About these terms

This website is operated by Alejandro Morales under the artistic name Ali Capa Foto, from Portugal. These terms apply to voluntary one-time contributions and to purchases or enquiries for books, photographic prints, and original artworks through this website.

Nothing in these terms limits rights that cannot legally be excluded, including mandatory consumer protections that apply where you live.

One-time archive contributions

The Stripe support link allows visitors to make a voluntary one-time contribution toward the continued creation, publication, and preservation of the Ali Capa photographic archive.

A contribution does not create a subscription or Patreon membership and does not purchase additional goods, services, commissions, personalised content, access rights, or rewards. Contributions are not represented as charitable or tax-deductible donations.

Contribution refunds

If a contribution was made by mistake, was duplicated, or you change your mind, contact alicapafoto@gmail.com within 14 days of payment and include the email address used at checkout and the payment date. Reasonable refund requests will be honoured where possible.

Photographic prints

Open-edition photographic prints are made to order through the fulfilment provider and specification shown on the product page. Limited collector editions may use different paper, sizes, certificates, numbering, and fulfilment arrangements.

The price of the print and the delivery charge are shown before payment. Delivery is paid by the buyer. Import duties, customs charges, or destination taxes not collected at checkout are normally the buyer’s responsibility where permitted by law.

A purchase is confirmed when Stripe reports successful payment and an order confirmation is issued. Production normally begins after payment has been confirmed. Product images are intended to represent the work accurately, but screens and physical papers can differ slightly in colour, brightness, texture, and surface reflection.

Original artwork enquiries and reservations

The original works displayed on the website are unique physical artworks. Sending an enquiry does not create a purchase contract and does not require payment.

Availability is confirmed individually. After availability and the complete price have been confirmed, a work may be reserved for 48 hours while you consider the quote. If payment is not completed by the stated deadline, the reservation may expire and the work may be made available again.

Price, shipping, and payment

Prices are displayed in euros unless otherwise stated. Shipping and any agreed insurance or handling are calculated separately for the destination and shown before payment. Ali Capa Foto does not advertise free shipping unless a specific promotion expressly says so.

Print and contribution payments are completed through Stripe-hosted Checkout. Original artworks may be paid through an itemised Stripe invoice after availability and the complete delivery price are confirmed. Ali Capa Foto does not receive or store complete card details.

The purchase is confirmed when full payment has been received and a payment or order confirmation has been sent. Stripe’s receipt is separate from any fiscal invoice or receipt required under Portuguese law.

Delivery

Production and delivery estimates are estimates rather than guaranteed dates unless expressly agreed in writing. Prints are made to order, and production normally takes approximately 36–72 hours before dispatch, although provider capacity, quality control, weekends, customs, and the selected service can affect timing.

The buyer is responsible for providing a complete and accurate delivery address and responding to reasonable carrier requests. Tracking is shared when available. Delays caused by carriers, customs, severe weather, strikes, or other events outside reasonable control may affect delivery.

Cancellations, returns, and damage

Where mandatory consumer law gives you a right to withdraw from an online purchase, including a 14-day cooling-off period after delivery in applicable cases, that right remains available. To exercise it, send a clear written notice to alicapafoto@gmail.com within the applicable period. Any legal exception for personalised or made-to-order goods applies only where the law actually permits it.

Unless an item is faulty, damaged, incorrectly supplied, or the law requires otherwise, the buyer is responsible for the direct cost of returning it. Returns must be sent back with reasonable care, in their original condition and protective packaging. A refund may be withheld until the item is received or evidence of return is supplied, as permitted by law.

If an order arrives damaged or incorrectly produced, photograph the outer packaging, label, and item and contact Ali Capa Foto as soon as reasonably possible. Reporting visible transit damage within 48 hours helps with the provider or carrier claim, but does not reduce mandatory legal rights.

Unique character and appearance

Each original work is made by hand and may contain surface, material, or finish characteristics that form part of the artwork. Measurements are approximate. Screen settings and photography may cause colour, texture, gold, varnish, or frame appearance to differ slightly from the physical work.

Additional photographs or practical details can be requested before payment.

Copyright and ownership

Purchase transfers ownership of the physical artwork only. Copyright and all reproduction, publication, licensing, commercial-use, and image rights remain with Ali Capa Foto unless a separate written agreement expressly states otherwise.

Photographs, text, design, and other creative material on this website may not be copied, published, sold, altered, used to train models, or commercially used without permission.

Payment processing and privacy

Stripe processes payments under its own terms and privacy policy. Cloudflare runs the storefront functions, and order fulfilment details may be passed to the selected professional printer and recorded in a restricted Google Sheet for fulfilment and accounting. Ali Capa Foto receives only the contact, transaction, delivery, and payment-status information needed to administer the order, maintain records, deliver the item, handle refunds, and respond to support requests.

Website content

The website contains fine-art photography and may include artistic nude imagery presented in an artistic and editorial context. Visitors are responsible for deciding whether the material is appropriate for them and lawful to access where they live.

The website and external services may occasionally be unavailable, changed, or withdrawn. To the extent permitted by law, Ali Capa Foto is not responsible for indirect losses or failures caused by third-party services, payment networks, internet interruptions, or events outside reasonable control.

Law and contact

These terms are governed by Portuguese law, without limiting mandatory consumer protections that apply in your country. Questions, payment issues, withdrawal notices, and refund requests can be sent to alicapafoto@gmail.com.

These terms may be updated when the website, support model, artwork sales process, payment setup, or applicable requirements change. The date at the top shows the latest revision.
